BILIMORIA FISHING TACKLE PRIVACY POLICY 

1               INTRODUCTION 

1.1                    This Policy explains how we obtain, use and disclose your personal information, as is required by the Protection of Personal Information Act 4 of 2013 (“POPIA”).

1.2                    At Bilimoria Fishing Tackle CC, Registration No. 2006/048937/23 (“Bilimoria” / “We” / “Us”) we are committed to protecting your privacy and to ensure that your personal information is collected and used properly, lawfully and transparently.

2               TYPE OF PERSONAL INFORMATION COLLECTED

2.1                    We collect and process your personal information mainly to provide you with access to our services and products, to help us improve our offerings to you and for certain other purposes explained below.

2.2                    The type of information we collect will depend on the purpose for which it is collected and used. We will only collect information that we need for that purpose.

2.3                    We collect information directly from you where you provide us with your personal details, for example when you purchase a product or services from us or when you submit enquiries to us or contact us. Where possible, we will inform you what information you are required to provide to us and what information is optional.

2.4                    We also collect information about you from other sources as explained below.

2.5                    Website usage information is collected using “cookies” which allows us to collect standard internet visitor usage information.

3               USE OF THE PERSONAL INFORMATION 

3.1                    We will use your personal information only for the purposes for which it was collected or agreed with you, for example:

3.1.1                               To provide and/or market our products or services to you, to carry out and administer the transaction or product that you requested, and/or contracted with us for, and to maintain our relationship;

3.1.2                               To assess and process refund/cancellation requests;

3.1.3                               To confirm and verify your identity or to verify that you are an authorised user for security purposes;

3.1.4                               For operational purposes;

3.1.5                               For the detection and prevention of fraud, crime, money laundering or other malpractice;

3.1.6                               For debt tracing or debt recovery;

3.1.7                               To conduct market or customer satisfaction research or for statistical analysis;

3.1.8                               For audit and record keeping purposes;

3.1.9                               For statistical and research purposes to improve our products and/or services;

3.1.10                            In connection with legal proceedings.

3.2                    We will also use your personal information to comply with legal and regulatory requirements or industry codes to which we subscribe or which apply to us, or when it is otherwise allowed by law (for example to protect our interests).

3.3                    Given our aim to provide you with products and services, we would like to use your information to keep you informed about other products and services which may be of particular interest to you. The aforesaid is only in the case where you have consented to same, by way of an opt in. We may contact you by phone, email or messaging applications for marketing purposes if you have opted in for same.

4               SHARING AND DISCLOSING OF PERSONAL INFORMATION 

4.1                    We may disclose your personal information to our service providers who are involved in the delivery of products or services to you. We have agreements in place to ensure that they comply with these privacy terms.

4.2                    We may share your personal information with, and obtain information about you from third parties for the purposes listed above;

4.3                    Other third parties from whom you have chosen to receive marketing information.

4.4                    We may also disclose your information:

4.4.1                               Where we have a duty or a right to disclose in terms of law or industry codes;

4.4.2                               Where we believe it is necessary to protect our rights.

4.5                    We are legally obliged to provide adequate protection for the personal information we hold and to stop unauthorised access and use of personal information. We will, on an ongoing basis, continue to review our security controls and related processes to ensure that your personal information is secure.

5               SECURTITY MEASURES

5.1                    We are committed to ensuring that your personal information, that we process, is secured. To prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and processing procedures to safeguard and secure your personal information.

5.2                    When we contract with third parties, we impose appropriate security, privacy and confidentiality obligations on them to ensure that personal information that we remain responsible for, is kept secure.

6               CROSS TERRITORY TRANSFER OF INFORMATION

6.1                    We may need to transfer your personal information to another country for processing or storage. 

6.2                    We will ensure that anyone to whom we pass your personal information agrees to treat your information with the same level of protection as we are obliged to.

7               YOUR OBLIGATIONS AND RIGHTS REGARDING YOUR PERSONAL INFORMATION THAT WE PROCESS

7.1                    You must provide us with legally acceptable proof of identity when enforcing the rights below.

7.2                    You must inform us, as soon as possible, if your personal information changes. 

7.3                    You are legally entitled to withdraw your consent for us to process your personal information. Note, however, that such withdrawal may affect our ability to provide you with services. The withdrawal of the aforesaid consent does not affect our right to process such personal information where consent is permitted, or required, by any applicable law.

7.4                    You have the following rights:

7.4.1                               The right of access to, and to request the rectification of, your personal information held by us.

7.4.2                               The right to object to us processing your personal information as held by us.

7.4.3                               The right to lodge a complaint with the Information Regulator.

7.5                    In order to exercise any of your rights as set out in 7.4 above, you must follow the processes and procedures set out in our PAIA Manual which can be accessed on https://www.bilimoriafishing.com/general-8.

7.6                    If you feel that we have not resolved your complaint/request adequately you can contact the Information Regulator at https://inforegulator.org,za/contact-us .

8               INFORMATION OFFICER

Bilimoria will appoint an Information Officer (“IO”), and possibly a Deputy Information Officer (“DIO”), who will be responsible for overseeing compliance with this Policy and POPIA.
